General Terms and Conditions of Sale for Provence Harmonie SARL Provence Arômes
Article 1: Scope and Modification of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale (GTC) apply to all orders placed on the website www.provenceharmonie.fr. They apply, without restriction or reservation, to all sales of products made via this site.
By placing an order on the website, the customer accepts without reservation these GTC, which they acknowledge having read and understood. Provence Arômes reserves the right to modify the GTC at any time. Any modification will be notified to customers via the website, and the GTC in force at the time of the order will apply.
Article 2: Product Availability
Our product and price offers are valid as long as they are visible on the website, within the limits of available stocks. In case of unavailability of a product after the validation of the order, we will offer you a similar product at an equivalent price or proceed with a full refund.
Article 3: Product Prices
Prices are indicated in euros (€), all taxes included (VAT included), excluding delivery costs. Delivery costs will be specified before the order is validated. Provence Arômes reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in force at the time of order registration.
Article 4: Ordering Process
To place an order, the customer follows these steps:
- Select products by clicking on "Add to cart".
- Validate the cart after checking the specifications of the order (description, quantity, price).
- Fill in the order form with personal information and create an account.
- Accept the GTC by checking the box "I have read the General Terms and Conditions of Sale and agree to them without reservation".
- Validate the payment and finalize the order with a "double click".
The customer is responsible for the accuracy of the information provided during the order. In case of error, Provence Arômes cannot be held responsible for the impossibility of delivering the order.
Article 5: Payment Methods and Security
5.1: Payment Methods
Payment for purchases is made in euros (€) by credit card, PayPal, check, or bank transfer. For payments by check or bank transfer, the order is reserved for 7 days. If payment is not received within this period, the order will be canceled.
5.2: Payment Security
Payments by credit card or PayPal are secured by SSL protocol. Provence Arômes never has access to the customer's banking information.
5.3: Transaction Control
Provence Arômes reserves the right to request additional information from the customer to verify the identity and good faith of the order, especially in the case of a high amount or a difference between the delivery address and the one linked to the payment method. In case of bank refusal or suspicion of fraud, the order will be canceled.
5.4: Retention of Title Clause
The products remain the property of Provence Arômes until full payment of the order. The transfer of risks occurs upon receipt of the order by the customer.
Article 6: Delivery Terms
Deliveries are made in mainland France and in the countries listed in the site's dropdown menu. Shipping costs are calculated based on weight and destination and are indicated during the order process.
Delivery times are given as an indication. In case of a delivery delay exceeding 30 days, the customer can cancel their order and obtain a full refund. In case of a problem upon receipt (damaged packaging, missing product), the customer must refuse the package and make reservations with the carrier.
Article 7: Responsibilities
Provence Arômes is responsible for the proper execution of the contract. However, its liability cannot be engaged in the event of force majeure, including strikes, natural disasters, or accidents. For products purchased for professional purposes, Provence Arômes is not liable for indirect damages.
Article 8: Right of Withdrawal
The customer has a period of 14 days from the receipt of their order to exercise their right of withdrawal, without having to justify reasons or pay penalties, except for return costs. The product must be returned in its original packaging, unused beyond what is necessary to establish its nature, characteristics, and proper functioning, and accompanied by all its accessories.
To exercise their right of withdrawal, the customer must notify their decision by an unequivocal statement (by email, phone, or mail). Provence Arômes will refund the customer within 14 days of receiving the returned product.
Article 9: Return Procedure
In case of a defective or non-conforming product, the customer must contact customer service to organize the return of the product. A return label will be provided, and return costs will be borne by Provence Arômes. The product must be returned in its original packaging and in good condition, with all its accessories.
Article 10: Warranty
The products sold by Provence Arômes are covered by the legal guarantees of conformity and hidden defects provided by Articles L217-4 and following of the Consumer Code and Articles 1641 and following of the Civil Code. The customer has 2 years to assert their rights.
Article 11: Protection of Personal Data
The customer's personal data is collected for the processing of orders and is protected in accordance with the French Data Protection Act and the General Data Protection Regulation (GDPR). The customer has the right to access, rectify, delete, and object to their data. Cookies may be used to improve the browsing experience, and the customer can configure their browser to refuse them.
Article 12: Mediation and Disputes
In case of a dispute, the customer can resort to a consumer mediator, in accordance with the provisions of the Consumer Code. These GTC are subject to French law, and any dispute will be the exclusive competence of the French courts.
